Article 2: Application of these general conditions of sale:
The general conditions presented above apply to any purchase made from the company CHATEAU DES COCCINELLES on its online store via the website www.chateau-coccinelles.com or by telephone. To find out the conditions of his order, the customer can click at any time, even before placing an order, on "General Conditions of Sale".
Placing an order implies the full and unrestricted acceptance by the CHATEAU DES COCCINELLES customer of the various clauses presented in these T&Cs. Only a written agreement stipulating special conditions between the two parties can be accepted, without which these conditions thus presented are automatically subject to the existing contractual relations between the Customer and the company CHATEAU DES COCCINELLES.
The offers presented by CHATEAU DES COCCINELLES are reserved for private customers.
Before confirming their order, the customer declares that they have accepted these T&Cs and, consequently, fully adhere to them.
Article 3: Ordering method:
All orders are made on the website www.chateau-coccinelles.com.
The customer creates a basket by choosing the number of products they want. Once their selection has been made, the customer validates their basket and their payment method.
After accepting the T&Cs, orders become final when they are validated by payment for the products.
The CHATEAU DES COCCINELLES verification department is entitled to require proof of identity and address from the customer to validate the order. In the event of refusal by the customer or non-conformity of the documents, CHATEAU DES COCCINELLES may refuse and cancel the order. For its part, if the customer does not want to submit to this check, this may cancel the order.
The verification service is also entitled to cancel certain orders if it considers that the latter presents various anomalies and irregularities (doubts about the identity of the customer, usurpation, creation of irregular accounts, etc.).
An invoice is issued by CHATEAU DES COCCINELLES and is available in the “my account” section on the website www.chateau-coccinelles.com. At the customer’s request, an invoice can be sent to them by email, or to their billing address. An order confirmation is sent by email.
In accordance with the terms of law n°80 336 of May 1, 1980, relating to the retention of title, the products remain the property of CHATEAU DES COCCINELLES until full payment of the invoices.
The customer becomes the owner and responsible for the items upon delivery, the transfer of possession constituting a transfer of risks.
Article 4: Payment methods and prices:

Payment for products can be made by check, bank cards (VISA, MASTERCARD, AMEX).
Checks:
Checks in Euros only and domiciled in France only. Addressed to the order of CHATEAU DES COCCINELLES at our head office: 6 Rue des Écoles, 30390 Domazan.
Due to non-payment, CHATEAU DES COCCINELLES may request additional information from its customer before accepting payment by check.
B- PRICE:
For France, prices are expressed in Euros (€) and displayed inclusive of all taxes (French VAT and all other applicable taxes). For other countries of the European Union, the price differs depending on the country of delivery of the product and will take into account the local VAT of the country of consumption and other taxes (excise duties).
The price indicated on the product sheets is indicated excluding transport costs. On the same product the price may vary depending on the quantities chosen. Transport costs vary depending on the delivery method chosen by the customer and depending on the country of delivery. THE DELIVERY RATES APPLICABLE WHEN ORDERING ARE AVAILABLE ON THE SITE.
The company CHATEAU DES COCCINELLES reserves the right to modify its sales prices.
All promotional operations (vouchers, discount vouchers, partner discounts, etc.) are limited to one person per household and per operation. CHATEAU DES COCCINELLES reserves the right to refuse orders that do not meet this criterion.
Article 5: Delivery:
National delivery: Upon receipt of payment for the order, CHATEAU DES COCCINELLES will begin the transport and delivery operations. The ordered items will be delivered to the address provided by the customer. The delivery information provided by the customer is binding on the customer. In the event of an error or lack of information resulting in a defect or absence of delivery, CHATEAU DES COCCINELLES will not be held liable. In the event of a return due to an incomplete address, the customer will have the option of either changing their address and having the goods reshipped, bearing the new return costs, or having the order refunded less the initial shipping costs.
Community delivery: For customers wishing to be delivered to an EU country mentioned in the list of countries delivered (Transport and Delivery), in the same way as for a national delivery, the company CHATEAU DES COCCINELLES is responsible for the delivery of its products. The list of EU member countries and the prices can be consulted on the "Transport and Delivery" page.
Responsibility for transport: It is the customer's responsibility to check the contents of the package upon receipt and to make reservations if necessary, as follows: on the delivery slip provided by the carrier or by immediately calling the carrier's customer service, in the presence of the delivery person. And, in all cases, by notifying the company CHATEAU DES COCCINELLES by REGISTERED LETTER addressed to its correspondence address within 2 days after receipt of the package AND by email to: commercial@chateau-coccinelles.com
Delivery times: CHATEAU DES COCCINELLES undertakes to do everything possible to deliver the products ordered as soon as possible. Delivery times vary depending on the product, the delivery method chosen and the country of destination of the goods. If the products in the order have different delivery times, the longest delivery time applies to the entire order.
ATTENTION: IN CASE OF DAMAGE OR BREAKAGE
IMPORTANT: The carrier is responsible for the integrity of the package during delivery.
It is the customer's responsibility to check the contents of the package upon receipt and to formulate precise and reasoned reservations stipulating the damage, if applicable, by writing them on the delivery note or the electronic box provided by the carrier. The customer also has the option of refusing the package if its integrity has not been preserved.

The customer must notify the company CHATEAU DES COCCINELLES within 48 hours maximum after receipt of the package by email to the following address: commercial@chateau-coccinelles.com
If all of the above conditions are met, CHATEAU DES COCCINELLES undertakes to offer a reshipment, credit or refund to the injured customer.
Article 6: Stock and out of stock:
In the event of a product being out of stock, CHATEAU DES COCCINELLES undertakes to keep the customer informed as soon as possible and will offer its customer various alternatives:
-Replacement of the out-of-stock product with the following vintage or with an equivalent or higher quality product under the same price conditions.
- Reimbursement of the unavailable product(s) or the entire order, depending on the customer's choice.
In the event of a temporary shortage, the customer will be offered the choice of waiting until the restocking date that will be indicated to him. The customer will have the option of accepting and waiting to receive his entire order, requesting partial or complete cancellation of his order.
Article 7: Commercial operations and benefits:
All promotional offers on the website www.chateau-coccinelles.com, such as the Flash Sales, Clearance, Damaged Labels sections and commercial operations such as sales (winter and summer), wine fairs are subject to special conditions. Indeed, these operations may be committed to a period of time, with a limit of stock, availability, quantity. At the end of the offer, the products are likely to change price. As a result, the customer benefits from this offer over a period of time and once this period has expired, CHATEAU DES COCCINELLES cannot undertake to offer the same advantages to the customer on another future order.
Article 8: Guarantee “CHATEAU DES COCCINELLES will refund the difference if you find a cheaper product elsewhere online”
Within 10 calendar days following the delivery date of the items purchased on the website www.chateau-coccinelles.com, the company CHATEAU DES COCCINELLES undertakes to reimburse any price difference noted on said products purchased for which the customer has noted a price difference to their disadvantage.
This guarantee applies when a strictly identical product (same producer/estate/château, same vintage, same color, same capacity, same certified origin) is found at a lower price on an online sales site, for the same number of bottles purchased. The price comparison is made on a site comparable to that of CHATEAU DES COCCINELLES (online wine sales) whose name is registered with the INPI and whose owner company is declared in the Trade and Companies Register.
As a result, commercial operations (sales, wine fairs, etc.), private online sites, auction sites, private sales sites (access to the site by registration, username and password) and private sales sites, as well as sites in liquidation (declared in "cessation of payment" or "judicial recovery" by the RCS) selling off stocks occasionally and/or at a loss, are excluded from the comparison.
The comparison and refund of the difference apply to the said “delivery included” items between the compared site and CHATEAU DES COCCINELLES, that is to say that the delivery costs charged are an integral part of the total cost price.
The request is made by simply sending an email, with acknowledgment of receipt, to the address commercial@chateau-coccinelles.com within the time limit, specifying the contact details of the seller and the price noted (attach the Internet link to the site). The refund will be made within 15 working days from the date of the comparison and its validation by our customer service.
Article 9: Right of withdrawal:
Terms
You have the right to withdraw from this contract without giving any reason within fourteen days.
The withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the goods.
To exercise this right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous statement (for example, a letter sent by post or e-mail).

In order to meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we will reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us) without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract.
We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you expressly agree otherwise; in any event, this reimbursement will not incur any fees for you. We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earliest.
You must return the goods in person or send them back to us at SCEA CHATEAU DES COCCINELLES – 6 Rue des Écoles, 30390 Domazan without undue delay and, in any event, no later than fourteen days after you have communicated to us your decision to withdraw from this contract. This deadline is deemed to have been met if you return the goods before the expiry of the fourteen-day period.
You will be responsible for the direct cost of returning the item.
You are only liable for any depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the goods. In the event that certain products have been started or consumed, CHATEAU DES COCCINELLES will be entitled to deduct these products from the refund made to the buyer.
Article 10: Applicable law and dispute resolution:
Consumer Mediation Service:
Amicable settlement of disputes between the professional and the consumer in accordance with articles L611-1 to L 641-1 and R 612-1 to R 616-2 of the Consumer Code.
In the event of an unresolved dispute between the Professional and the Consumer, the consumer has the option of contacting the consumer mediator.
Before contacting the consumer mediator, the consumer must have already attempted to resolve his dispute directly with the professional by means of a written complaint or have made a complaint under the terms of the contract concluded with the professional.
Consumer mediation is an out-of-court settlement of consumer disputes.
If the conditions are met, consumer mediation will take place according to a precise process and in accordance with the texts in force.

Applicable Law and Competent Jurisdiction
These general terms and conditions of sale are governed by French law. If any clause of these conditions is found to be null and void, this will not affect the validity or compliance with these conditions. In the event of a persistent disagreement concerning these present conditions and in the absence of an amicable agreement, any dispute will be brought before the competent French courts.
Reimbursement deadlines
In the event of a refund following a dispute, we undertake to refund you the amount agreed with our customer service without undue delay and no later than fourteen days from the day on which you agreed in writing on this refund with our customer service. In the event of a refund in exchange for a return of goods, we may defer the refund until we have received the goods or until you have provided proof of shipment of the returned goods, the date retained being that of the first of these facts. For refunds by credit card, please note that interbank delays may delay the actual credit on your account by a few days.
Article 11: Protection of minors:
The provisions of the Public Health Code concerning the sale of alcohol to minors have been amended in Article 93 of the HPST law. The sale of alcohol is prohibited to those under 18 years of age.
When registering, the customer must acknowledge that they are of legal age. In addition, with each order, upon validation and before payment, the customer, by accepting these General Terms and Conditions, will again acknowledge that they are of legal age.
Article 12: Data protection:
In accordance with Law No. 78-17 of 6 January 1978 on Information Technology, Data Files and Liberties, you have the right to access, rectify and delete personal data concerning you that is processed under the responsibility of CHATEAU DES COCCINELLES. In order to meet customer needs and ensure optimal remote service, CHATEAU DES COCCINELLES is required to record certain personal data (name, first name, address). This information is intended exclusively for CHATEAU DES COCCINELLES.
