Article 2: Application of these general terms and conditions of sale:
The general terms thus presented apply to any purchase made from the company CHATEAU DES COCCINELLES in its online shop via the website www.chateau-coccinelles.com or by telephone. To find out the conditions of their order, the customer may click at any time, even before placing an order, on «General Terms and Conditions of Sale».
Placing an order implies the full and unreserved acceptance by the CHATEAU DES COCCINELLES customer of the various clauses presented in these GTC. Only a written agreement stipulating special conditions between the two parties may be accepted; failing this, these conditions as presented apply by right to the contractual relationships existing between the Customer and the company CHATEAU DES COCCINELLES.
The offers presented by CHATEAU DES COCCINELLES are reserved for private customers.
Before validating their order, the customer declares that they have accepted these GTC and, consequently, fully adhere to them.
Article 3: Ordering procedure:
All orders are placed on the website www.chateau-coccinelles.com.
The customer builds a basket by choosing the number of products they wish. Once their selection has been made, the customer validates their basket and their payment method.
After accepting the GTC, orders become final when they are validated by payment for the products.
The verification department of CHATEAU DES COCCINELLES is entitled to require proof of identity and address from the customer in order to validate the order. In the event of refusal by the customer or non-compliance of the documents, CHATEAU DES COCCINELLES may refuse and cancel the order. For their part, if the customer does not wish to submit to this check, this may cancel the order.
The verification department is also entitled to cancel certain orders if it considers that the latter presents various anomalies and irregularities (doubts about the customer's identity, impersonation, creation of irregular accounts, etc.).
An invoice is issued by CHATEAU DES COCCINELLES and is available in the «my account» section on the website www.chateau-coccinelles.com. At the customer's request, an invoice may be sent to them by email, or to their billing address. An order confirmation is sent by email.
In accordance with the terms of law no. 80 336 of 1 May 1980, relating to retention of title, the products remain the property of CHATEAU DES COCCINELLES until full payment of the invoices.
The customer becomes the owner of and responsible for the items as soon as they are delivered, the transfer of possession constituting transfer of risk.
Article 4: Payment methods and prices:

Payment for the products can be made by cheque, bank cards (VISA, MASTERCARD, AMEX).
Cheques:
Cheques in Euros only and domiciled in France only. Made payable to CHATEAU DES COCCINELLES at our registered office: 6 Rue des Écoles, 30390 Domazan.
Due to unpaid amounts, CHATEAU DES COCCINELLES may request additional information from its customer before accepting payment by cheque.
B- PRICES:
For France, prices are expressed in Euros (€) and displayed inclusive of all taxes (French VAT and any other applicable taxes). For the other countries of the European Union, the price differs according to the country of delivery of the product and will take into account the local VAT of the country of consumption and the other taxes (excise duties).
The price indicated on the product sheets is indicated excluding transport costs. On the same product the price may vary according to the quantities chosen. Transport costs vary according to the delivery method chosen by the customer and according to the country of delivery. THE DELIVERY RATES APPLICABLE AT THE TIME OF ORDERING ARE AVAILABLE ON THE SITE.
The company CHATEAU DES COCCINELLES reserves the right to modify its selling prices.
All promotional operations (purchase vouchers, discount vouchers, partner discounts…) are limited to one person per household and per operation. CHATEAU DES COCCINELLES reserves the right to refuse orders that do not meet this criterion.
Article 5: Delivery:
National delivery: Upon receipt of payment for the order, CHATEAU DES COCCINELLES initiates the transport and delivery operations. Delivery of the ordered items takes place at the address provided by the customer. The delivery information indicated by the customer binds the latter. In the event of an error or lack of information resulting in faulty or non-delivery, the company CHATEAU DES COCCINELLES cannot be held liable. In the event of a return due to an incomplete address, the customer will have the option either to modify their address and have the goods re-shipped, bearing the new return costs, or to be refunded for the order less the initial shipping costs.
Community delivery: For the customer wishing to have delivery made to an EU country mentioned in the list of countries delivered to (Transport and Delivery), in the same way as a national delivery, the company CHATEAU DES COCCINELLES takes charge of the conveyance of its products. The list of EU member states as well as the pricing can be consulted on the «Transport and Delivery» page.
Responsibility for transport: It is the customer's responsibility to check the contents of the parcel at the time of receipt and to formulate reservations where applicable, in the following manner: on the delivery note provided by the carrier or by immediately calling the carrier's customer service, in the presence of the delivery person. And, in all cases, by notifying the company CHATEAU DES COCCINELLES by REGISTERED LETTER addressed to its correspondence address within 2 days after receipt of the parcel AND by email to: commercial@chateau-coccinelles.com
Deadlines: The company CHATEAU DES COCCINELLES undertakes to do everything possible to deliver the ordered products as quickly as possible. The deadlines vary according to the product, the delivery method chosen and the country of destination of the goods. If, in the order, the products have different delivery times, it is the longest delivery time that applies to the entire order.
WARNING: IN THE EVENT OF DAMAGE OR BREAKAGE
IMPORTANT: It is the carrier who is responsible for the integrity of the parcel during delivery.
It is the customer's responsibility to check the contents of the parcel at the time of receipt and to formulate precise and substantiated reservations stipulating the damage, where applicable, by recording them on the delivery note or the electronic device provided by the carrier. The customer also has the option of refusing the parcel if its integrity has not been preserved.

The customer must notify the company CHATEAU DES COCCINELLES within a maximum of 48 hours after receipt of the parcel by email to the following address: commercial@chateau-coccinelles.com
If all the preceding conditions are met, the company CHATEAU DES COCCINELLES undertakes to offer a re-shipment, a credit note or a refund to the aggrieved customer.
Article 6: Stock and out of stock:
In the event of a product ordered being out of stock, CHATEAU DES COCCINELLES undertakes to keep the customer informed as quickly as possible and will offer its customer various alternatives:
-The replacement of the out-of-stock product with the following vintage or with an equivalent product or one of higher quality under the same pricing conditions.
-The refund of the unavailable product(s) or of the entire order according to the customer's choice.
In the event of a temporary shortage, the customer will be offered the choice of waiting until the restocking date which will be indicated to them. The customer will have the option of accepting and waiting to receive their entire order, or requesting the partial or full cancellation of their order.
Article 7: Commercial operations and advantages:
All the promotional offers present on the website www.chateau-coccinelles.com, such as the Flash Sales, Clearance, Damaged Labels sections and commercial operations such as the sales (winter and summer), the wine fairs are subject to particular conditions. Indeed, these operations may be committed to a duration, to a limit of stock, of availability, of quantity. At the end of the offer, the products are liable to change price. As a result, the customer benefits from this offer over a time interval and, once the latter has expired, CHATEAU DES COCCINELLES cannot undertake to offer the customer the same advantages on another future order.
Article 8: Guarantee «CHATEAU DES COCCINELLES refunds the difference if you find a cheaper product elsewhere online»
Within a period of 10 calendar days following the date of delivery of the items purchased on the website www.chateau-coccinelles.com, the company CHATEAU DES COCCINELLES undertakes to refund any price difference found on the said purchased products for which the customer has noted a price difference to their disadvantage.
This guarantee applies when a strictly identical product (same producer/estate/château, same vintage, same colour, same capacity, same certified origin) is found at a lower price on an online sales site, for the same number of bottles purchased. The price comparison is made on a site comparable to that of CHATEAU DES COCCINELLES (online wine sales) whose name is registered with the INPI and whose owning company is registered with the Trade and Companies Register.
As a result, excluded from the comparison are commercial operations (sales, wine fairs, etc.), private online sites, auction sites, private sale sites (access to the site by registration, username and password) and private-to-private sales sites, as well as sites in liquidation (declared in «suspension of payments» or in «receivership» by the RCS) clearing stock on an ad hoc basis and/or at a loss.
The comparison and the refund of the difference apply to the said items «delivery included» between the compared site and CHATEAU DES COCCINELLES, that is to say that the delivery costs applied are an integral part of the total cost price.
The request is made by simply sending an email, with a request for acknowledgement of receipt, to the address commercial@chateau-coccinelles.com within the allotted time, specifying the seller's contact details and the price found (attach the Internet link of the site). The refund will be made within 15 working days from the date of the comparison and its validation by our customer service.
Article 9: Right of withdrawal:
Conditions
You have the right to withdraw from this contract without giving any reason within a period of fourteen days.
The withdrawal period expires fourteen days after the day on which you yourself, or a third party other than the carrier and designated by you, takes physical possession of the goods.
To exercise this right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous statement (for example, a letter sent by post or email).
You may use the withdrawal form to be downloaded from the following link: form to download, but this is not mandatory.
In order for the withdrawal period to be respected, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the expiry of the withdrawal period.
Effects of withdrawal
In the event of your withdrawal from this contract, we will refund you all payments received from you, including delivery costs (with the exception of the additional costs arising from the fact that you have chosen, where applicable, a delivery method other than the least expensive standard delivery method that we offer) without undue delay and, in any event, no later than fourteen days from the day on which we are informed of your decision to withdraw from this contract.
We will carry out the refund using the same means of payment as the one you used for the initial transaction, unless you expressly agree to a different means; in any event, this refund will not incur any costs for you. We may defer the refund until we have received the goods or until you have provided proof of dispatch of the goods, the date retained being that of the first of these facts.
You must return the goods in person or send them back to us at SCEA CHATEAU DES COCCINELLES – 6 Rue des Écoles, 30390 Domazan without undue delay and, in any event, no later than fourteen days after you have communicated your decision to withdraw from this contract to us. This period is deemed to be respected if you send back the goods before the expiry of the fourteen-day period.
You will have to bear the direct costs of returning the goods.
Your liability is engaged only with regard to the depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of these goods. In the event that certain products have been opened or consumed, CHATEAU DES COCCINELLES reserves the right to deduct these products from the refund made to the buyer.
Article 10: Applicable law and dispute resolution:
Consumer Mediation Service:
Amicable settlement of disputes between the professional and the consumer in accordance with articles L611-1 to L 641-1 and R 612-1 to R 616-2 of the Consumer Code.
In the event of an unresolved dispute between the Professional and the Consumer, the consumer has the possibility of referring the matter to the consumer mediator.
Before referring the matter to the consumer mediator, the consumer must already have attempted to resolve their dispute directly with the professional by means of a written complaint or have made a complaint in accordance with the terms of the contract concluded with the professional.
Consumer mediation is an out-of-court settlement of consumer disputes.
If the conditions are met, a consumer mediation will take place according to a precise process and according to the texts in force.

Applicable law and competent jurisdiction
These general terms and conditions of sale are governed by French law. If one of the clauses of these conditions proves null and void, this would affect neither the validity nor the observance of these conditions. In the event of persistent disagreement concerning these conditions and in the absence of an amicable agreement, any dispute shall fall under the jurisdiction of the competent French courts.
Refund deadlines
In the event of a refund following a dispute, we undertake to refund you the sum agreed with our customer service without undue delay and no later than fourteen days from the day on which you agreed to this refund in writing with our customer service. In the event of a refund in exchange for a return of goods, we may defer the refund until we have received the goods or until you have provided proof of dispatch of the returned goods, the date retained being that of the first of these facts. For refunds by bank card, please note that interbank delays may postpone the actual credit to your account by a few days.
Article 11: Protection of minors:
The provision of the Public Health Code concerning the sale of alcohol to minors was modified in article 93 of the HPST law. The sale of alcohol is prohibited to persons under 18 years of age.
Upon registration, the customer must acknowledge that they are of legal age. Furthermore, with each order, upon validation and before payment, the customer, by accepting these GTC, will again acknowledge that they are of legal age.
Article 12: Data protection:
In accordance with law no. 78-17 of 6 January 1978, relating to Information Technology, Files and Civil Liberties, you have a right of access, rectification and deletion of the personal data concerning you and being processed under the responsibility of CHATEAU DES COCCINELLES. You may exercise it by contacting our customer service by email at: commercial@chateau-coccinelles.com or by post.
In order to meet customers' needs and ensure optimal remote service, the company CHATEAU DES COCCINELLES is led to record certain personal data (surname, first name, address). This information is intended exclusively for CHATEAU DES COCCINELLES.
Payments by bank card are secured by an online payment system compliant with SSL standards. Furthermore, all the banking information you provide us with during your online purchase is neither stored nor visible on the Internet.
